GENERAL RULES OF THE CEMETERY
Maintaining, improving, and beautifying of the cemeteries for the burial of the dead is declared to be one of the first considerations of a civilized people. lt is to this end that the Cemetery District adopted the following rules and regulations for the information of families and morticians in order to carry out this solemn duty as compassionately as possible in a fair, efficient, and convenient manner and still offer as much freedom of choice as possible.
- Only permissive burial rights are sold and the Millville-Nibley Cemetery District retains title to cemetery properties. Commercial businesses are excluded from purchasing burial rights. Please see the current fee schedule for pricing. A delay fee will be assessed to the family or mortuary for extended time at the cemetery, beyond one (1) hour to cover the cost of cemetery personnel.
- If, after a period of sixty (60) years, a plot(s) has not been used, the District may reclaim the property by following the procedures under Title 8, Chapter 123, Utah Code Annotated, 2002 as amended.
- Burial rights are conveyed to the person named, their heirs and/or others so named and properly documented. Purchase of a cemetery lot is for the right to burial only. Rights may be transferred to heirs per will, trust, probate or consensus of all family members. Cemetery lots are not to be used as an investment. Resale of lots except to Millville-Nibley Cemetery is prohibited. Re-purchase of lots is for the dollar amount originally paid. Utah code 75-2-102
- It is the responsibility of the family, or their authorized representative to meet with a Cemetery District Representative, this being the Sexton or a Cemetery Board Member, at least forty-eight (48) hours prior to a burial, unless the deceased will not be embalmed. The plot shall be chosen and payment arrangements made at that time, unless it has been previously purchased.
- Vaults shall be structurally sound and made of concrete or equivalent composite material. The top and sides of the vault shall be perpendicular with square corners. The vault shall withstand the probing used at the time of locating the grave site. The vault exception is for infants and cremation burials. Inspection of the vault shall be by the Cemetery District Representative prior to internment.
- Cremations require an urn which can be sealed, and which is made of a non-corrosive material.
- Burial plots are laid out in rows with the head of the grave to the west and the foot to the east. According to traditional burial custom, the wife will be placed to the left side of the husband, unless otherwise requested.
- Not more than one (1) casket per plot is allowed except for infants. Then there can be up to four (4) infants per plot. Only one (1) interment will be allowed in a casket with the exception of a mother or a father with infant children, or two (2) minor children buried at the same time.
- Double use of a plot, such as placing a cremated individual on top of the casket of the previously buried individuals are permitted. Up to four (4) cremations may be placed in one (1) grave site. However, an open/close fee is required for each addition to the plot and payment must be arranged for with the appropriate Cemetery District Representative before the internment.
- Grave-side services will be held in a timely and expedient manner with a Cemetery District Representative present at the opening and closing of the grave.
- Headstones must be confined within the space of purchased lot and located on the west end of the plot. All headstones are required to have a six (6) inch cement mow-strip around the perimeter of the base, no larger than 2 ft by 4 ft in size. No more than one (1) raised headstone per lot will be permitted. A forty-eight (48) hour notice shall be given to the Cemetery District Representative before any headstone can be installed. Headstones are considered the owner’s personal property, and all care and upkeep are the owner’s responsibility. A permanent headstone is required within one year of internment. The Millville-Nibley Cemetery District will not be responsible for damage to temporary markers. Cemetery Maintenance personnel will take precautions to protect headstones during routine cemetery maintenance but assumes no responsibility for damage to headstones that extend above the surface of the ground. The family may make arrangements with a monument company to move a headstone if necessary. If the headstone is too big or cumbersome for the district to move, the district can require the family to make arrangements with a monument company to move. The district will not be liable for damages to headstones unless the damage is due to the districts negligent, reckless, or intentional conduct.
- A disinterment and removal of remains from the cemetery is permitted by following the procedures and requirements of Title 26, Chapter 2, Part 17, Utah Code Annotated, 1953, as amended. Arrangements for the removal of the remains must be made with the Cemetery District Representative, and all applicable fees for opening and closing of the grave are to be paid to the Cemetery District Representative
- Mausoleums are not permitted within the cemetery.
- Pet or animal burials are not allowed within the cemetery.
- Planting of trees, shrubs, flowers, digging or disturbing the sod is allowed only under the Cemetery Board's approval. Any trees planted require purchasing a separate plot where no one will be buried.
- Decorations or flowers (natural and artificial) may be left if they are on the headstone or are in permanently attached vases If they do not interfere with routine maintenance. All shepherds’ hooks shall be permanently mounted on the headstone base and drilled and glued into the base. Glass containers for flowers shall not be permitted due to breaking glass being a safety hazard. Funeral flowers will be discarded after seven (7) days if not removed. Flowers and other grave decorations (are permitted) for Memorial Day holiday. Decorations may be placed starting the Friday before until Sunday, the following week. Everything will be removed the following Monday morning.
- In the event any of the above rules are violated, the District shall be authorized to assess a penalty against the violating party, whether it be the family of the deceased or the mortuary involved. The penalty shall be determined by the Board after reviewing the circumstances and considering the inconvenience caused to the District.
- All Eagle Scout projects, or other volunteer services shall be approved by the Cemetery Board before being accepted.
- All fees listed here-in for Cemetery services shall be paid to the Millville-Nibley Cemetery District. The fees may be paid to a funeral home that agrees to pay us from those fees. If that option is chosen, the person paying the fees must notify us within 48 hours of burial.
- No recreational use of the cemetery, roads, or veteran memorial shall be permitted.
- Damage to cemetery property shall be paid by the persons responsible.
